Trial, Cancellation & Refund Policy

Plain-language summary. An eligible new web customer may receive one 24-hour Pro trial. A payment method is required, and Pro automatically renews at the price and cadence shown at checkout unless canceled before the exact trial end. Max has no web trial and is charged immediately. Apple and Google control their separate 3-day native-app trials. The exact offer shown immediately before checkout controls the voluntary refund route for that transaction.

1. Scope and policy hierarchy

This Policy applies to trials, recurring subscriptions, and one-time purchases for ZSky AI services offered by ZSky LLC ("ZSky," "we," "us"). It forms part of the Terms of Service.

The transaction-specific disclosure presented immediately before checkout controls if it conflicts with general marketing copy. For purchases billed by Apple or Google, the applicable store's billing and refund rules also apply. Nothing in this Policy excludes, restricts, or replaces a right or remedy that cannot lawfully be waived in your jurisdiction.

3. Web Pro 24-hour trial

4. Direct web purchases

Max never receives a free web trial. A customer who already used the web Pro evaluation is charged immediately for Pro. In limited first-purchase routes, checkout may expressly display a 24-hour, substantially-unused voluntary refund option.

"Substantially unused" is assessed from objective service records, including successful generations, exports or downloads, premium-feature use, storage use, and compute consumed. Any successful Developer API request ends voluntary refund eligibility for an API-enabled purchase. Failed or blocked generations are not treated as successful use. There is no fixed generation cap on a trial or paid plan; this usage review applies only to the narrow voluntary refund route.

If checkout states that a transaction has no voluntary refund window, that disclosure controls. Renewals, trial conversions, and subsequent direct purchases are not voluntarily refundable.

5. Apple App Store and Google Play

Apple and Google may each offer a separate 3-day Pro trial under their own eligibility and billing rules. An Apple trial grants trial access only in the iOS app. A Google Play trial grants trial access only in the Android app. Neither native trial can be transferred to the web or to the other native platform.

After Apple or Google confirms a successful positive subscription payment, paid subscription access may be available across supported ZSky platforms while that paid entitlement remains valid. Store purchases, cancellations, charge timing, and refunds are processed under the store's rules. Use Apple's refund process or the Google Play refund process where applicable.

6. One-time purchases, credits, and Fast Pass

One-time digital benefits are delivered immediately and are not voluntarily refundable once delivered, consumed, or applied to an account. Duplicate charges, unauthorized charges, delivery failures, and mandatory statutory remedies remain covered.

7. Failed payments, retries, and access

A payment-method setup or authorization does not guarantee available funds at renewal. Stripe and the payment network may decline a charge or require additional authentication. We may retry a failed recurring charge as permitted by the checkout terms and applicable law. Paid access is granted only from authoritative provider status; an unconfirmed browser return page does not grant access.

If a payment fails, paid access may be suspended or end. You remain responsible only for charges validly incurred under the disclosed recurring terms, subject to applicable law.

8. Service failures, billing errors, and unauthorized charges

The voluntary exclusions above do not prevent review of a duplicate charge, incorrect amount, unauthorized transaction, or material failure of a paid feature. Contact [email protected] promptly. We may provide a refund, credit, re-performance, or other remedy based on the evidence and applicable law.

A refund or charge reversal may terminate the related paid access and reverse unused promotional or subscription benefits. Fraudulent disputes, trial cycling, payment abuse, or material misrepresentation may result in trial refusal, suspension, or account termination.

9. Mandatory consumer rights

Some jurisdictions provide cancellation, withdrawal, conformity, or consumer-guarantee rights beyond this voluntary Policy. For example, qualifying EU distance contracts can carry a statutory withdrawal period subject to rules for services and immediately supplied digital content; checkout separately asks for affirmative immediate-performance consent and acknowledgement. Australian consumer guarantees cannot be removed by a "no refunds" statement. We apply those rights where they govern.

10. How to cancel or request review

  1. For a web subscription, use Account Settings > Billing to cancel future renewal.
  2. For a voluntary direct-purchase refund review, email [email protected] within 24 hours of the charge and include the account email, charge date, plan, and reason. Do not send a full card number.
  3. For Apple or Google Play billing, use the store's subscription and refund controls.

Canceling stops future renewal but does not itself issue a refund. If the account portal is unavailable, email [email protected] before the deadline; we use the received timestamp.

11. Changes

We may update this Policy prospectively. The policy version and disclosure accepted for a completed transaction remain part of that transaction's audit record. Material changes to an existing recurring subscription will be communicated as required by applicable law.
